3. Platform Terms of Use

3.1 Licence to use
PesaPact grants an eligible user a personal, limited, revocable and non-exclusive licence to access the platform in
accordance with these rules.
3.2 Marketplace conduct
Communicate honestly and respectfully.
Do not pressure another user to transact outside documented platform controls.
Do not request passwords, OTPs or unnecessary identity documents.
Do not discriminate unlawfully or use protected personal characteristics as improper credit criteria.
Do not publish another user’s debt, identity documents or private communications.
Do not manipulate ratings, trust scores, offers, payment records or evidence.
Do not use bots, scraping or bulk messaging without written approval.
3.3 Matching and ranking
Search results, matching, trust indicators and rankings are informational tools. They are not financial advice, a credit
guarantee or a certification of a user’s ability to repay.
PesaPact should disclose the principal factors that materially influence ranking and should monitor algorithms for
unfair outcomes, data-quality errors and manipulation.
3.4 Content and evidence
Users grant PesaPact permission to host and process content submitted for platform operation, compliance, dispute
resolution and legal claims. Users retain ownership of their original content.
PesaPact may preserve relevant content and logs after account closure where reasonably necessary for an active
loan, dispute, fraud investigation or legal obligation.
3.5 Availability and changes
The platform may be unavailable during maintenance, third-party outages, security incidents or circumstances
beyond reasonable control. PesaPact will take reasonable steps to preserve records and restore service.
Features affecting loan economics, acceptance, payments, enforcement or privacy must not be materially changed
without appropriate notice and updated acceptance.
3.6 Enforcement
PesaPact may warn, restrict, suspend or close an account for breach, fraud risk, regulatory concerns or danger to
users. Decisions should be proportionate, documented and reviewable.
Suspension does not authorise PesaPact to appropriate customer money or cancel a valid bilateral debt.
